Shoppin shall process such information only to the extent reasonably necessary for the relevant Service, transaction, verification, legal or regulatory requirement, or other lawful purpose, and in accordance with applicable law.

Where any document contains personal data relating to another individual, the Customer shall ensure that the Customer has the necessary authority or lawful basis to provide such document or information to Shoppin.

Where required for a transaction, delivery, customs clearance, regulatory compliance or fraud prevention, Shoppin may also collect additional identification or verification information, including government-issued identification details or documents, where such collection is lawful and reasonably necessary for the relevant purpose.

5. Payment Information

Where you make a payment for Products or Services, Shoppin may receive information necessary to identify and reconcile the relevant transaction, including transaction reference numbers, payment status, billing information, payment method and limited or masked payment details.

Payments may be processed through independent payment gateways, banks, card networks, financial institutions or other payment service providers. Depending upon the payment method and provider, complete payment-card or banking credentials may be collected and processed directly by the relevant payment provider rather than being stored by Shoppin.

Shoppin does not intend to retain complete payment-card information unless such retention is expressly required for a lawful business purpose and permitted under applicable law.

Payment providers may independently process personal data in accordance with their own privacy policies and applicable legal requirements.

6. Technical and Usage Information

Such information may be used to operate, secure, maintain and improve the Platform, analyse usage patterns, diagnose technical issues, prevent fraud and abuse, maintain security and understand how Customers interact with the Services.

7. Cookies and Similar Technologies

Shoppin may use cookies, pixels, web beacons, software development kits and similar technologies to operate and secure the Website, remember preferences, maintain sessions, understand Website usage, measure performance and, where legally permissible, support marketing and advertising activities.

Cookies may be categorised as essential cookies, functional cookies, analytics or performance cookies and marketing or advertising cookies, depending upon their purpose.

Where required by applicable law, Shoppin shall seek the appropriate consent before placing or using non-essential cookies or similar technologies.

8. Sources From Which Personal Data May Be Collected

Shoppin may collect personal data directly from you when you register, make an enquiry, place a Booking, make a payment, request a quotation, communicate with customer support, submit information through the Website or otherwise interact with Shoppin.

Where legally permissible and reasonably necessary for providing the Services, Shoppin may also receive personal data from third parties, including Sellers, manufacturers, retailers, marketplaces, courier companies, logistics providers, payment processors, fraud-prevention service providers, business partners and other persons involved in the fulfilment of your Booking.

Where you provide personal data concerning another individual, including a recipient of a gift or shipment, you represent that you are authorised or otherwise legally entitled to provide such information for the relevant purpose.

9. Purposes for Which Personal Data Is Processed

Shoppin processes personal data only for lawful and specified purposes and, where required, on the basis of consent or another lawful ground recognised under applicable law.

Shoppin may process personal data to verify identity, authenticate transactions, prevent fraud, detect suspicious activity, protect the security of the Platform, investigate misuse and protect the rights, property and interests of Shoppin, Customers and other persons.

Personal data may further be processed where necessary for compliance with applicable law, including taxation, accounting, regulatory, customs, import and export, legal, judicial and governmental requirements.

Subject to applicable law and any consent or other legal requirement applicable to such processing, Shoppin may also use personal data for analytics, research, service development, quality assurance, business administration and improvement of the customer experience.

Where Shoppin proposes to process personal data for a purpose materially different from the purpose for which such data was originally collected, Shoppin shall provide any notice or obtain any consent required under applicable law before undertaking such processing.

10. Notice and Consent

Where consent is required under applicable law, Shoppin shall seek consent through an appropriate mechanism and shall endeavour to ensure that such consent is specific, informed, unambiguous and capable of being demonstrated.

Where required under the DPDP Rules or other applicable law, Shoppin’s notice concerning personal data shall identify the categories of personal data being collected and the specified purposes for which such personal data is processed, including the goods, services or uses enabled by such processing.

Where processing is based upon consent, you may withdraw such consent through the mechanism made available by Shoppin, subject to applicable law and the consequences of such withdrawal.

The withdrawal of consent shall not affect the lawfulness of processing undertaken before the withdrawal.

Where certain personal data is necessary for Shoppin to provide a requested Product or Service, withdrawal of consent or refusal to provide such information may result in Shoppin being unable to provide some or all of the relevant Services.

11. Disclosure of Personal Data to Sellers and Suppliers

In booking to provide the Services, Shoppin may disclose necessary personal data to Sellers, manufacturers, retailers, suppliers, distributors and other persons involved in sourcing or supplying Products.

For example, where necessary to complete a purchase or fulfil a Booking, Shoppin may provide a Customer’s name, contact details, shipping information or other relevant information to the Seller or supplier.

Shoppin shall endeavour to limit such disclosure to information reasonably necessary for the relevant purpose and shall undertake such processing in accordance with applicable law.

A Seller or supplier may independently process personal data in accordance with its own privacy policy and applicable law. Shoppin shall not be responsible for the independent processing activities of a third party that are outside Shoppin’s control, except to the extent liability is imposed upon Shoppin under applicable law.

12. Disclosure to Couriers, Logistics Providers and Customs Authorities

Where a Customer requests delivery, particularly international delivery, Shoppin may disclose relevant personal data to courier companies, freight forwarders, shipping carriers, warehouse operators, customs brokers, customs authorities, government authorities and other logistics or regulatory entities where such disclosure is necessary for fulfilment, transportation, customs clearance, compliance or delivery.

Such information may include the Customer’s name, address, telephone number, email address, shipment details, Product information and identification or documentation required for customs or regulatory purposes.

Where an international shipment is involved, the Customer acknowledges that the processing and disclosure of such information may be necessary for the lawful movement and clearance of the shipment.

13. Disclosure to Payment and Financial Service Providers

Shoppin may disclose or make available relevant personal data to payment gateways, banks, card networks, payment processors, financial institutions, foreign-exchange providers and other financial service providers for purposes including payment processing, transaction verification, fraud prevention, refunds, chargeback management and reconciliation.

Such third parties may process personal data in accordance with their own legal obligations and privacy policies.

14. Third-Party Data Processors and Service Providers

Shoppin may appoint or engage third-party service providers and data processors to perform functions on its behalf, including Website hosting, cloud storage, software services, analytics, cybersecurity, customer support, communications, payment processing, fraud prevention, logistics coordination and other business functions.

Where appropriate and required by applicable law, Shoppin may impose contractual or other obligations upon such service providers concerning confidentiality, security and lawful processing of personal data.

Shoppin shall take reasonable steps, having regard to the nature and purpose of the processing, to ensure that personal data entrusted to service providers is processed in accordance with applicable law and contractual requirements.

15. International Transfer and Cross-Border Processing

Because Shoppin may provide Services to Customers located in different countries and may use international technology, payment, logistics, customer-support or other service providers, personal data may be processed, stored or transferred across national borders.

Any such processing or transfer shall be undertaken subject to applicable data-protection requirements and any restrictions, safeguards or conditions prescribed by applicable law from time to time.

Where applicable law imposes restrictions upon the transfer of personal data to a particular jurisdiction or class of entity, Shoppin shall comply with such restrictions.

16. Government, Law Enforcement and Legal Disclosures

Shoppin may disclose personal data where such disclosure is required or permitted by applicable law, including in response to a valid legal process, court booking, governmental direction, regulatory requirement or lawful request from a competent authority.

Shoppin may also process or disclose personal data where reasonably necessary to detect, prevent or investigate fraud, unlawful activity, security incidents, misuse of the Platform, violations of the Terms and Conditions or threats to the rights, safety or property of Shoppin, Customers or other persons.

Where legally permitted, Shoppin may take reasonable steps to notify the relevant individual before making such disclosure; however, no such notification shall be required where prohibited by law or where doing so could prejudice an investigation, legal proceeding or regulatory requirement.

17. Business Reorganisation and Corporate Transactions

As a corporate entity, Thinkorporation Tech Private Limited may from time to time undertake or participate in a merger, acquisition, restructuring, financing, investment, sale or transfer of business or assets, joint venture, corporate reorganisation or similar transaction.

In connection with such a transaction, personal data may be disclosed to prospective or actual purchasers, investors, advisers, lenders, professional consultants or successor entities, subject to applicable law and appropriate confidentiality and data-protection requirements.

Where a transaction results in a change in the entity responsible for processing personal data, Shoppin shall take such steps as may be required under applicable law.

18. Data Retention

Shoppin may retain personal data for as long as reasonably necessary for the purposes for which such data was collected or processed, including for providing Services, maintaining customer and transaction records, processing future or continuing requests, customer support, accounting, taxation, audit, legal, regulatory, customs, fraud-prevention, dispute-resolution, security and enforcement purposes.

Subject to applicable law, Shoppin may retain personal data and related documents, communications, Booking records, quotations, invoices, payment records, photographs, videos, chat records and other transaction-related information until the Customer requests deletion, clearance or erasure of such information, or until Shoppin otherwise determines that such information is no longer required to be retained.

A Customer may request deletion, erasure or clearance of personal data by contacting Shoppin through the contact details specified in this Privacy Policy. Upon receiving such a request, Shoppin shall assess and process the request in accordance with applicable law.

Notwithstanding a Customer’s request for deletion or clearance, Shoppin may retain such personal data or records, to the extent legally permitted or required, where retention is necessary for compliance with applicable law, taxation, accounting, audit, legal proceedings, regulatory requirements, fraud prevention, dispute resolution, enforcement of contractual rights, protection of Shoppin’s legitimate interests, or establishment, exercise or defence of legal claims.

Where personal data is no longer required and there is no lawful basis or requirement for continued retention, Shoppin may erase, anonymise or otherwise dispose of such information in accordance with applicable law and its internal procedures.

19. Data Security

Shoppin shall implement reasonable technical and organisational measures appropriate to the nature, volume and risk associated with the personal data processed by it.

Such measures may include access controls, authentication mechanisms, encryption or other protective technologies where appropriate, secure hosting arrangements, employee or contractor confidentiality obligations, monitoring, backup procedures, vulnerability management and incident-response procedures.

Access to personal data within Shoppin shall be limited to persons who require such access for legitimate business, contractual, operational, legal or compliance purposes.

Notwithstanding the security measures implemented by Shoppin, no electronic transmission, storage system, website or internet-based service can be guaranteed to be completely secure. Accordingly, Shoppin cannot guarantee absolute security of personal data against every possible threat.

20. Personal Data Breaches

A personal data breach may include unauthorised access, disclosure, acquisition, sharing, use, alteration, destruction or loss of access to personal data, or any other incident recognised as a personal data breach under applicable law.

Where Shoppin becomes aware of a personal data breach, Shoppin shall assess and respond to the incident in accordance with its incident-response procedures and applicable law.

Where notification to affected individuals, the Data Protection Board of India, or any other authority is required under applicable law, Shoppin shall provide such notification within the applicable statutory timelines and in the manner prescribed by law.

21. Customer Rights

Subject to the provisions, conditions and limitations of applicable law, individuals may have rights in relation to their personal data, including the right to obtain information concerning the processing of their personal data, seek correction or updating of inaccurate or incomplete personal data, request erasure where legally applicable, withdraw consent where processing is based upon consent, nominate another individual in accordance with applicable law, and seek grievance redressal.

Where applicable law provides additional rights or prescribes specific procedures for exercising such rights, Shoppin shall comply with those requirements.

Requests concerning personal data may be submitted through the contact details specified in this Privacy Policy.

Shoppin may require reasonable information or verification to establish the identity and authority of a person making a request before acting upon a request involving personal data, particularly where disclosure or alteration of such information could create a risk of unauthorised access.

22. Withdrawal of Consent

Where Shoppin processes personal data on the basis of consent, the individual may withdraw such consent through the mechanism made available by Shoppin.

Shoppin shall endeavour to make the withdrawal process reasonably accessible and, where required by applicable law, comparable in ease to the process through which consent was provided.

Withdrawal of consent shall not invalidate processing lawfully undertaken before the withdrawal.

Where the withdrawal of consent prevents Shoppin from lawfully providing a particular Service, Shoppin may be unable to continue providing that Service or may need to suspend or terminate the relevant portion of the Customer relationship, subject to applicable law.

23. Grievance Redressal

Any individual who has a concern regarding the processing of personal data by Shoppin may first contact Shoppin through the grievance mechanism specified below.

Shoppin shall endeavour to examine and address grievances within the period prescribed under applicable law.

If a grievance remains unresolved after the applicable internal grievance process, the individual may exercise any further right available under applicable law, including approaching the competent authority or the Data Protection Board of India, as applicable.

24. Children’s Personal Data

Shoppin recognises the importance of protecting children’s personal data.

Shoppin shall process the personal data of children only in accordance with applicable law, including any requirements concerning verifiable parental or lawful guardian consent, processing of children’s data and restrictions on activities involving children’s personal data.

Shoppin does not knowingly seek to collect children’s personal data in circumstances prohibited by applicable law.

Where Shoppin becomes aware that personal data relating to a child has been collected or processed in circumstances not permitted by applicable law, Shoppin shall take reasonable steps to address the situation in accordance with applicable law.

25. Marketing and Promotional Communications

Subject to applicable law and any consent or other lawful basis required for the relevant processing, Shoppin may use customer-related information and materials for advertising, marketing, promotional, informational, educational, social-media, website, campaign and other promotional purposes in connection with Shoppin and its Services.

For these purposes, and subject to applicable law, Shoppin may use or reproduce portions of successful Booking-related communications and interactions, including customer chats, messages, photographs, videos, product-selection communications, customer feedback, reviews, testimonials, screenshots, service interactions and other materials voluntarily provided or generated in connection with a successful Booking, where such use is reasonably connected with demonstrating, promoting or explaining Shoppin’s Services.

Where such material is used for public marketing, advertising or promotional purposes, Shoppin shall take reasonable steps to avoid publicly displaying or disclosing the Customer’s personal contact information, including telephone number, email address, residential address, payment information, account credentials or other information that is not reasonably required for the promotional purpose. Shoppin may anonymise, redact, crop, blur or otherwise modify such information before publication.

The Customer acknowledges that screenshots, chats, photographs, videos or other Booking-related material may contain contextual information which, even after removal of direct contact information, may potentially identify the Customer. Where applicable law requires consent for such promotional use, Shoppin shall obtain the required consent before undertaking such use.

A Customer who does not wish for their Booking-related chats, photographs, videos, testimonials, reviews or other identifiable customer-related material to be used for public marketing or advertising may contact Shoppin and request that such material be excluded from future marketing use or that identifying portions be blurred, redacted or otherwise removed, subject to applicable law and any legitimate use or publication that has already occurred.

Shoppin may continue to use information that has been lawfully anonymised, aggregated or otherwise rendered non-identifiable, to the extent permitted by applicable law.

Nothing in this clause authorizes Shoppin to publicly disclose passwords, payment credentials, government identification numbers, private financial information, medical information or other highly sensitive personal information for advertising or promotional purposes unless expressly authorized by the Customer and permitted by applicable law.

26. Analytics and Service Improvement

Shoppin may analyse information concerning the use of the Platform and Services for purposes including understanding customer behaviour, measuring Website performance, identifying technical issues, improving product discovery, developing new Services, improving customer experience and maintaining security.

Where analytics information is capable of identifying an individual, Shoppin shall process such information in accordance with applicable law and this Privacy Policy.

Where reasonably practicable and appropriate, Shoppin may use aggregated or anonymised information for analytical, statistical, research and business purposes.

27. Third-Party Websites and Services

The Platform may contain links to websites, applications or services operated by third parties.

A third-party website or service may collect and process personal data independently of Shoppin and may have its own privacy policy and terms of use.

Shoppin does not control and shall not be responsible for the privacy practices, security measures, content or data-processing activities of independent third-party websites or services.

Customers are advised to review the privacy policies of third-party websites before submitting personal data to them.

28. Social Media and Messaging Platforms

Shoppin may maintain accounts or business profiles on social-media and messaging platforms.

If you communicate with Shoppin through such platforms, the relevant platform may independently collect and process personal data in accordance with its own terms and privacy policy.

Shoppin shall process information received through such platforms in accordance with this Privacy Policy and applicable law, to the extent such information is within Shoppin’s control.

29. Employees, Contractors and Authorised Personnel

Access to Customer personal data by employees, consultants, contractors and authorised personnel of Shoppin shall be limited to information reasonably necessary for the performance of their assigned functions.

Shoppin may require such persons to maintain confidentiality and comply with applicable information-security and data-protection requirements.

30. Accuracy of Personal Data

Customers are responsible for providing accurate and up-to-date personal data to Shoppin and for notifying Shoppin of material changes where such information is necessary for providing the Services.

Shoppin shall take reasonable steps, having regard to the purpose of processing, to maintain the accuracy and completeness of personal data under its control.

31. Data Minimisation

Shoppin shall endeavour to collect and process only such personal data as is reasonably necessary for the specified purposes for which it is processed.

Shoppin does not intend to collect personal data merely because such information is available where there is no legitimate or lawful purpose for processing it.

32. Automated Decision-Making and Profiling

Shoppin may use automated tools, analytics systems or fraud-prevention technologies to assist with operational processes, security, personalisation or transaction monitoring.

Where automated processing results in a decision having legal or similarly significant effects on an individual, Shoppin shall comply with any applicable requirements governing such processing.

Shoppin shall not use automated processing in a manner inconsistent with applicable law.

33. Prohibited and Restricted Items

Shoppin operates as a shopping, sourcing, procurement, personal assistance and shipping-coordination service and may facilitate transactions and shipments involving different countries, jurisdictions, customs authorities, carriers and service providers. The import, export, purchase, possession, transportation or delivery of Products may therefore be subject to restrictions imposed by the country of origin, destination country, transit country, customs authorities, government authorities, payment providers, airlines, shipping carriers, courier companies or other applicable regulatory bodies.

The Customer shall not request, instruct, authorise or attempt to use Shoppin for the purchase, sourcing, transportation, export, import, delivery or handling of any Product which is prohibited, restricted, regulated, dangerous, unlawful or otherwise not acceptable under applicable law or the policies of the relevant carrier, courier, logistics provider, customs authority or other service provider.

Without limiting the foregoing, Shoppin may refuse to procure, accept, store, consolidate, pack, transport, export, import or deliver Products falling within categories including, but not limited to, narcotic drugs, psychotropic substances, controlled substances, illegal drugs, prohibited pharmaceutical products, prescription medicines where shipment or import is not legally permitted, counterfeit or pirated goods, goods infringing intellectual property rights, firearms, ammunition, explosives, weapons, weapon components, prohibited knives or other restricted weapons, military or defence-related equipment, hazardous or dangerous goods, radioactive or nuclear materials, toxic or corrosive substances, flammable liquids or solids, compressed gases, biological or infectious materials, chemicals requiring special handling, and other hazardous materials.

Shoppin may also refuse or restrict Products including, without limitation, electronic cigarettes, vaping devices, vape cartridges, e-cigarette liquids and related products where their import, export, transport, sale, storage or possession is prohibited or restricted. In India, electronic cigarettes are subject to the statutory prohibition under the Prohibition of Electronic Cigarettes Act, 2019, which covers their production, manufacture, import, export, transport, sale, distribution, storage and advertisement.

Products containing lithium-ion, lithium-metal, sodium-ion or other batteries, including mobile phones, laptops, tablets, cameras, power banks, batteries, battery-operated equipment, electric devices, e-bikes, scooters and similar products, may be subject to dangerous-goods requirements, packaging requirements, documentation requirements, quantity restrictions, state or carrier restrictions and restrictions based on the method of transportation. The mere presence of a battery shall not necessarily make a Product prohibited; however, Shoppin may refuse or restrict any such Product where the applicable carrier, route, destination, law or safety requirement does not permit its transportation.

Shoppin may further restrict or refuse the shipment of alcoholic beverages, tobacco and nicotine products, e-cigarettes and vaping products, perfumes and products containing flammable liquids, aerosols, paints, solvents, adhesives, fuels, oils, chemicals, pesticides, fertilisers, gases, fireworks, matches, lighters and other products classified as dangerous goods or hazardous materials.

Shoppin may restrict or refuse the shipment of food products, beverages, medicines, supplements, cosmetics, personal-care products, plants, seeds, soil, agricultural products, animal products, meat, dairy products, biological materials, insects, animals, wildlife products and products derived from protected or endangered species where the relevant jurisdiction requires permits, licences, quarantine clearance, health certificates or other regulatory approvals, or where shipment is prohibited.

Shoppin may also restrict or refuse the shipment of gold, silver, precious metals, precious stones, jewellery, bullion, coins, antiques, cultural property, valuable artwork, high-value collectibles, cash, currency, negotiable instruments and similar high-value items where applicable customs, declaration, import, export, valuation, licensing or reporting requirements apply. For example, Dubai/UAE customs rules impose specific controls and declaration requirements concerning precious metals, precious stones, cash and other categories of goods.

Other restricted categories may include drones, satellite phones, radio transmitters, telecommunications equipment, surveillance equipment, certain medical or surgical equipment, scientific equipment, dual-use goods, products subject to export controls, encryption-related equipment, products requiring government approval, and any Product whose import or export is restricted in the relevant jurisdiction. Indian customs guidance, for example, identifies categories such as firearms, narcotic drugs, counterfeit goods, wildlife products, certain plants and animals, gold and silver, satellite phones and drones as prohibited or restricted in specified circumstances.

The above categories are illustrative and shall not be treated as an exhaustive list. A Product that is lawful in India may nevertheless be prohibited, restricted, licensable or subject to special conditions in another country. Similarly, a Product that is permitted for domestic transportation may be prohibited or restricted for international transportation, air transportation or transportation through a particular carrier or route.

The Customer is solely responsible for providing accurate and complete information concerning the Product, its intended use, destination, recipient and any other information reasonably required for determining shipment eligibility. The Customer shall not conceal, misdescribe, undervalue, misclassify, incorrectly declare or otherwise provide false or misleading information concerning any Product or shipment.

Shoppin may request additional documents, licences, permits, declarations, certificates, prescriptions, identification documents or other information before accepting or completing a Booking. Shoppin may refuse, suspend, cancel or return a Booking where it reasonably believes that the Product or transaction may violate applicable law, customs requirements, sanctions, trade controls, carrier rules, payment-provider requirements or Shoppin’s internal compliance standards.

Where a Product is refused, detained, confiscated, destroyed, returned, delayed or otherwise affected by customs, a government authority, carrier, courier, logistics provider or other competent authority because of its prohibited or restricted nature, the Customer may be responsible for all applicable costs, duties, penalties, storage charges, return charges, disposal charges and other reasonable costs to the extent permitted by applicable law.

Shoppin does not undertake to maintain an exhaustive or permanently current list of prohibited or restricted Products for every country or jurisdiction. Restrictions may change without notice and may differ according to the country of origin, destination country, transit country, carrier, mode of transportation, quantity, value, intended use, licence status and other circumstances. The acceptance of a Product for procurement or shipment shall not constitute a representation or guarantee by Shoppin that the Product is legally importable, exportable, transportable or possessable in the relevant jurisdiction.

The Customer acknowledges that Shoppin may refuse a transaction even where a Product is legally available for purchase, if Shoppin determines that the proposed shipment cannot reasonably be completed in compliance with applicable law, carrier requirements, customs requirements, safety standards or Shoppin’s internal risk and compliance policies.

34. Information Security and Customer Responsibility

Customers are responsible for maintaining the confidentiality of passwords, account credentials, verification codes and other authentication information associated with their account.

Customers shall immediately notify Shoppin if they reasonably suspect unauthorised access to their account or misuse of their credentials.

Shoppin shall not be responsible for unauthorised access resulting solely from a Customer’s failure to safeguard their own credentials, except to the extent liability is imposed upon Shoppin by applicable law.

35. Retention of Communications and Records

Shoppin may retain relevant correspondence, Booking records, quotations, invoices, payment records, delivery records, complaints and other business records for as long as reasonably necessary for legitimate business purposes, legal compliance, accounting, taxation, audit, fraud prevention, dispute resolution and enforcement of contractual rights.

Where a communication is relevant to a Booking, complaint, payment dispute or legal matter, Shoppin may retain the communication for the applicable period even if the Customer subsequently requests deletion, where retention is legally permitted or required.

36. Data of Recipients and Other Persons

Where a Customer provides Shoppin with personal data relating to another individual, including a gift recipient, family member, employee, colleague or other recipient, the Customer shall ensure that such disclosure is lawful and that the Customer has the necessary authority or permission to provide the information.

Shoppin may process such information only for the relevant purpose for which it has been provided and in accordance with applicable law.

37. Legal and Regulatory Compliance

Shoppin may retain, process and disclose personal data where reasonably necessary to comply with applicable corporate, taxation, accounting, consumer-protection, customs, import/export, anti-fraud, cybersecurity, legal or regulatory requirements.

Nothing in this Privacy Policy shall prevent Shoppin from complying with a lawful obligation or direction issued by a competent authority.

38. Changes to This Privacy Policy

Shoppin reserves the right to amend or update this Privacy Policy from time to time to reflect changes in its Services, business operations, technology, legal requirements, regulatory requirements or data-processing practices.

The revised Privacy Policy shall be published on the Website with an updated “Last Updated” date.

Where applicable law requires prior notice, consent or any other action in connection with a material change to this Privacy Policy, Shoppin shall take such action as may be required.

Customers are encouraged to periodically review this Privacy Policy to remain informed about Shoppin’s data-processing practices.

39. Governing Law

This Privacy Policy shall be governed by and construed in accordance with the laws of India, including applicable data-protection and privacy legislation.

Nothing in this Privacy Policy shall be interpreted as excluding or restricting any mandatory statutory right or remedy available to an individual under applicable law.

40. Severability

If any provision of this Privacy Policy is determined by a competent court, tribunal or authority to be unlawful, invalid or unenforceable, such provision shall, to the extent legally permissible, be modified or severed without affecting the validity and enforceability of the remaining provisions.
